  • Environmental audio variations

may occur as part of the artistic process.
These characteristics are not considered defects.

Westchilds Productions (“Company,” “we,” “our,” or “us”) provides photography and videography services, including but not limited to digital photography, film photography, cinematic videography, and motion content creation.

By booking services, accessing our website, or engaging with our content, you agree to these Terms & Conditions.

 

2. Booking & Payment

  • A signed agreement and non-refundable retainer are required to secure any booking.

  • Dates are not reserved until the retainer is received.

  • Final payment is due according to the timeline outlined in the client agreement.

  • Failure to pay may result in cancellation of services and withholding of deliverables.

 

3. Creative Rights & Artistic Discretion

Westchilds Productions retains full creative control over all photography and videography sessions.

Client acknowledges:

  • Editing style, color grading, sound design, pacing, and final selection of images/video clips are at the sole discretion of Westchilds Productions.

  • RAW footage and unedited files are not included and will not be delivered unless explicitly agreed in writing.

 

4. Copyright & Ownership (Photography + Videography)

All photographs, video footage, digital files, audio recordings, and edited deliverables created by Westchilds Productions are protected under United States Copyright Law.

Westchilds Productions retains full copyright ownership of all media created.

Clients are granted a limited, non-transferable, non-exclusive license for personal use unless otherwise specified in a written commercial agreement.

Without prior written permission, clients may NOT:

  • Sell media

  • Alter, re-edit, or apply filters

  • Submit footage for commercial publication

  • Provide footage to vendors for advertising

  • Enter media into contests

  • Use media for paid promotions or advertisements

Commercial usage requires a separate licensing agreement.

 

5. Portfolio, Marketing & Business Use (Important Clause)

By booking services with Westchilds Productions, the client grants Westchilds Productions irrevocable permission to use photographs and video content from their session for any business-related purpose.

 

This includes but is not limited to:

  •  

  • Portfolio display (digital and print)

  • Website galleries

  • Social media platforms

  • Marketing campaigns

  • Paid advertisements

  • Print materials

  • Studio samples

  • Pitch decks

  • Behind-the-scenes content

  • Educational or speaking engagements

  • Promotional reels

If a client requires privacy or confidentiality, this must be requested in writing prior to the session and may be subject to an additional fee.

 

6. Website Content Protection & Unauthorized Use

All content displayed on this website — including but not limited to photographs, video clips, still frames, branding elements, logos, design, and written copy — is the exclusive intellectual property of Westchilds Productions.

 

No individual or business may:

  •  

  • Screenshot

  • Download

  • Screen-record

  • Copy

  • Reproduce

  • Distribute

  • Modify

  • Republish

  • Use content for AI training, reproduction, or derivative works

without express written permission.

Unauthorized use constitutes copyright infringement and may result in legal action, statutory damages, and recovery of attorney’s fees.

 

7. Videography-Specific Provisions

A. Audio Limitations

Westchilds Productions is not responsible for audio interference caused by venue restrictions, DJ equipment, wireless interference, or environmental factors beyond our control.

B. Coverage Limitations

Client is responsible for obtaining necessary venue permissions and permits for photography or videography coverage.

C. Delivery Timeline

Video production involves editing, color grading, audio mixing, and rendering. Delivery timelines are estimates and may vary depending on project scope.

 

8. Limitation of Liability

Westchilds Productions is not liable for:

  • Equipment malfunction (backup equipment is maintained)

  • Venue restrictions

  • Weather conditions

  • Acts of God

  • Client lateness or non-cooperation

  • Missed moments due to restrictions outside of Company control

Liability is limited to the total amount paid by the client.

 

9. Governing Law

These Terms are governed by the laws of the State of New Jersey and the State of New York, depending on where services are rendered.
